Terms of service

Last updated 30 October 2026

These terms are the agreement between you and Affily ("we") for using the Affily website, dashboard, API and link domains. By creating an account or using the API you accept them on behalf of yourself and any business you act for.

The short version

  • Affily is software for tracked links, analytics, conversion attribution and affiliate programmes.
  • We never take a cut of your sales, and never deduct anything from what your partners earn.
  • We never receive, hold or move your money. You pay your partners from your own account.
  • Your data is yours. We process it for you under our data processing terms.
  • Links must not be used for harm. We can switch off a link or pause a workspace that breaks the acceptable use rules.

Accounts and workspaces

You need to be at least 16 and give us accurate details. Each workspace has owners who decide who else can use it. You are responsible for everything done in your workspaces, by your team and with your API keys, so keep keys and sign-in links private and tell us at hello@affily.io if you think one has been misused.

Affily is a business tool. If you use it as a consumer, nothing in these terms affects the rights the law gives you that can't be changed by agreement.

Plans, prices and billing

Plans, usage rates, extras and add-ons are published on our pricing page. Paid plans aren't on sale yet; this section applies once they are.

  • Core is free. It has fixed limits and is never billed. When you reach a limit, the next action is refused until the limit resets or you upgrade.
  • Paid plans are billed monthly in advance. Usage beyond what your plan includes is billed in arrears at the published rates, unless you set a hard cap, in which case we stop at the cap instead.
  • Prices in pounds and euros include VAT. Prices in dollars don't include sales tax or VAT; where tax applies, we add it to the invoice.
  • You can upgrade at any time (charged pro rata) and downgrade or cancel at any time, effective at the end of the current billing period. We don't refund part-months.
  • If a payment fails we will email you and try again. If it is still unpaid after 14 days, we may limit the workspace to the Core plan's features until it is paid.
  • We may change prices with at least 30 days' email notice. A change applies from your next billing period after the notice ends.

Affiliate programmes and payouts

If you run a programme, the agreement about commissions is between you and your partners. Affily calculates commissions from the conversions you and your integrations send us, and prepares your payouts. You decide what to pay.

  • We never hold your money. Affily never receives, holds or transfers money you pay to partners. You pay them from your own account, using the payout list we prepare or, once available, by instructions you authorise us to send to your own payment provider account.
  • The payout list is free. Automated payout runs, where available, have a fee of 1% of the amount paid out in the run, billed on your Affily invoice and never deducted from what your partners receive. Your payment provider may charge its own fees, billed to you by the provider.
  • Check each payout before you approve it. We aren't responsible for payments you make on the basis of data you or your integrations sent us, or for a payment provider's actions.
  • You are responsible for your programme's terms, for tax on what you pay, for your partners' compliance with advertising rules (in the UK, affiliate links and codes are ads and must be clearly disclosed), and for the claims made about your products.

Your data and your visitors

You own the content and data you put into Affily, and you can export or delete it at any time. You give us permission to use it only to run the service for you. For personal data in it, such as the people who click your links, you are the controller and we are your processor under our data processing terms, which form part of these terms. How we handle our own customers' data is in our privacy policy.

If you track conversions, you are responsible for telling your visitors in your own privacy notice and, where the law requires it, getting their consent before tracking them.

Acceptable use

You must not use Affily, or any link made with it, to:

  • send people to malware, phishing, scams or other sites that try to deceive them or take their data or money;
  • share anything illegal, including child sexual abuse material, terrorist content, or the sale of illegal goods;
  • infringe someone else's rights, such as copyright, trade marks or privacy, or impersonate a person or business;
  • harass, threaten or promote hatred against people;
  • send spam: unsolicited bulk messages containing Affily links;
  • hide where a link really goes, for example by showing our checks one page and visitors another;
  • break another platform's rules on links or advertising, or the law on advertising, consumer protection or privacy;
  • probe, overload or get around the service's limits and security, or use it to resell link services in your own name without our written agreement (agencies managing workspaces for clients are welcome).

We check where links go when they are created and when someone reports them, and we act on reports sent throughReport a link. If a link breaks these rules or fails our safety checks, we can switch it off: it then shows a page saying it isn't available. A workspace with repeated problems can be paused for review: its working links keep working, but new links can't be made until we have looked at it. We tell the workspace's owners when either happens. If you think we got it wrong, reply to that email and a person will review it.

Core is meant for real use, not bulk traffic: if a Core workspace's links get unusually high traffic, we may ask visitors to click through a short page before redirecting, or ask you to move to a paid plan.

The API

Use the API within the rate limits for your plan. We version the API and won't make breaking changes to a version you use without at least 90 days' notice, except where security or the law requires a faster change.

The service and changes to it

We work hard to keep Affily available and your links working, but we don't promise the service will be uninterrupted or error-free. We may improve or change features; if we remove a feature you pay for, we'll give you at least 30 days' notice.

We may update these terms. For a change that affects you, we'll email account owners at least 30 days before it takes effect; if you don't agree, you can close your account before then. The date at the top shows the latest version.

Our property

Affily, its software, design and brand belong to us. You may use them only as these terms allow. If you send us feedback, we may use it without owing you anything.

Liability

  • Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn't allow us to limit.
  • Neither of us is liable for indirect or consequential loss, or for loss of profit, revenue, data or goodwill.
  • Otherwise, each side's total liability in any 12 months is limited to the fees you paid us in those 12 months, or £100 if that is more.
  • You are responsible for claims against us arising from your links, your content, your programme or your use of the service in breach of these terms.

Ending the agreement

You can close your account at any time from the dashboard. We can suspend or close an account that breaks these terms, doesn't pay, or that we must close by law; except for serious abuse or legal reasons, we'll warn you first. After an account closes you have 30 days to export your data, after which we delete it as our privacy policy describes. Commission and payout records are kept as long as tax law requires.

General

These terms, the data processing terms and the plan you choose are the whole agreement between us. If part of them can't be enforced, the rest still applies. You can't transfer this agreement without our agreement; we may transfer it to a business that takes over Affily. Neither of us is liable for delays caused by events outside our reasonable control. The law of England and Wales governs these terms, and its courts decide any dispute.
